Terms of Service for Location-Based Services
These Terms shall take effect on April 10, 2026.
Chapter 1: General Provisions
Article 1 (Purpose)
The purpose of these Terms of Service (the “Terms”) is to define the rights, obligations, and responsibilities of GNA COMPANY Inc. (the “Company”) and its Members (individuals who have agreed to the Playio Terms of Use operated by the Company) in relation to the use of location-based services (the “Services”) provided by the Company.
Article 2 (Effectiveness and Amendment)
1.
These Terms shall become effective when a Member or a personal location information subject who intends to use the Services agrees to them.
2.
By clicking the “Agree” button within the Service, a Member is deemed to have read, understood, and agreed to all provisions of these Terms.
3.
Members may withdraw their consent to the collection and use of location information at any time via Customer Support, or restrict/suspend location access through their mobile device’s OS permission settings.
4.
If the Company amends these Terms, it shall notify Members via in-app notices or the app’s initial screen at least seven (7) days prior to the effective date. However, for amendments that are unfavorable to Members, at least thirty (30) days’ prior notice shall be provided.
5.
If a Member does not agree to the amended Terms, they may discontinue use of the Service and delete their account. Continued use of the Service after the effective date without objection shall be deemed acceptance of the amended Terms.
Article 3 (Application of Relevant Laws)
These Terms shall be applied in accordance with relevant laws and commercial practices. Matters not specified herein shall be governed by the Playio Terms of Use, Privacy Policy, the "Act on the Protection and Use of Location Information," the "Personal Information Protection Act," and other applicable laws and regulations of the Republic of Korea.
Chapter 2: Services
Article 4 (Service Content and Fees)
1.
In principle, the Services are provided 24 hours a day, year-round. However, the Services may be temporarily suspended for technical or operational reasons, in which case notice will be provided either before or after such suspension.
2.
The Company provides location-based services based on the real-time GPS latitude and longitude of the Member’s device.
3.
Location-based services are provided based on the user’s optional consent. Even if consent is not given, basic services may still be used without restriction. However, separate consent is required to use the specific location-based features described below:

4.
The Services are provided free of charge in principle. However, wireless data communication fees may be incurred in accordance with the user’s mobile carrier plan.
Article 5 (Collection Method and Retention Period of Personal Location Information)
1.
The Company collects personal location information by obtaining GPS coordinates from the user’s device and transmitting them to a secure server with the Member’s consent and OS-level permissions.
2.
Personal location information shall be destroyed without delay once the purpose of collection, use, or provision has been fulfilled, the Service is terminated, or the Member withdraws consent (including account deletion). However, where retention is required by applicable laws or separate user consent, such information shall be retained for the period specified therein.
3.
In accordance with the Act on the Protection and Use of Location Information, confirmatory data regarding the collection, use, and provision of location information is automatically recorded and retained for at least six (6) months before being deleted.

Chapter 3: Protection of Rights and Obligations
Article 6 (Member Obligations)
1.
Members must maintain appropriate device settings for proper use of the Services and must not use third-party software (e.g., GPS manipulation apps or bypass programs) or devices to falsify or manipulate location information.
2.
Members must not use the Services beyond their intended scope or engage in unlawful activities, including the unauthorized collection or misuse of another person’s location information.
3.
If a Member obtains in-app benefits (e.g., rewards or quest rewards) through manipulation of location information or fraudulent activity, the Company may reclaim such benefits and impose measures such as service restrictions or termination of the user agreement.
Article 7 (Limitation and Suspension of Service)
The Company may restrict or suspend the Services in any of the following cases:
1.
If a Member intentionally or through gross negligence interferes with the operation of the Service (e.g., fraudulent matching attempts).
2.
If it is unavoidable due to inspection, maintenance, or construction of service facilities.
3.
In the event of force majeure, such as natural disasters or national emergencies.
4.
If there are other significant reasons deemed difficult to continue providing the Service.
Article 8 (Use and Provision of Personal Location Information to Third Parties)
1.
The Company collects, uses, and provides only the minimum personal location information within the scope of the Member’s consent, and does not use or disclose such information beyond that scope without additional consent.
2.
The Company automatically records and retains confirmatory data on the collection, use, and provision of location information for at least six (6) months.
3.
The Company may use personal location information or confirmatory data without consent only in the following cases:

When required for billing, settlement, or dispute resolution related to the provision of Services
•
When provided in a form that does not identify specific individuals for statistical, academic, or market research purposes
4.
To ensure service reliability and prevent fraudulent activities (e.g., improper reward claims), the Company may use personal location information as part of a Fraud Detection System (FDS).
Article 9 (Rights of Personal Location Information Subjects)
1.
Members may, at any time, withdraw all or part of their consent for the provision of services and third-party provision using personal location information through the in-app settings or Customer Support.
2.
Members may request temporary suspension of the collection, use, or provision of personal location information at any time, and the Company will not refuse such requests.
3.
Members may request access to or notification of confirmatory data related to their location information and may request correction if such data is inaccurate.
Article 10 (Rights of Legal Representatives)
The Service restricts membership to users aged 14 and above. However, where permitted by applicable law, if a user under the age of 14 uses the Service, the Company must obtain consent from both the user and their legal representative for the provision of location-based services and any third-party disclosures. In such cases, the legal representative shall have all rights granted to Members under Article 9.
Chapter 4: Compensation and Others
Article 11 (Designation of Location Information Manager)
The Company designates a Location Information Manager to properly manage and protect location information and to handle user complaints as follows:

Article 12 (Compensation for Damages and Indemnification)
1.
If the Company violates the provisions of the "Act on the Protection and Use of Location Information" and causes damage to a Member, the Company shall be liable for damages unless it proves that there was no intent or negligence.
2.
The Company shall not be liable for damages arising from causes beyond its reasonable control, including natural disasters, the Member’s fault, or intentional interference by third parties.
3.
If a Member causes damage to the Company by violating these Terms, the Company may claim damages against the Member.
Article 13 (Dispute Resolution)
1.
If a dispute related to location information cannot be resolved through consultation between the parties, the Member may apply for adjudication to the Korea Communications Commission or apply for mediation to the Personal Information Dispute Mediation Committee.
2.
Any dispute arising out of or in connection with these Terms shall be governed by the laws of the Republic of Korea, and the Seoul Central District Court shall have exclusive jurisdiction as the court of first instance.
Addendum
These Terms shall become effective on April 10, 2026.
